a. Temma Freight offers international shipping services operating (but not limited to) in Panama, Venezuela, Costa Rica and the main office in Miami, USA. The services provided by Temma Freight include, but are not limited to, shipping, logistics, and freight forwarding.
b. You may use our website to obtain quotes, place orders, and track shipments.
c. We reserve the right to change, suspend, or discontinue any aspect of the Site or the services provided by Temma Freight at any time, including the availability of any feature, database, or content.
Use of Our Website
a. You may use our website only for lawful purposes and in accordance with this Agreement.
b. You may not use our website: (i) in any way that violates any applicable federal, state, local, or international law or regulation; (ii) for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise; (iii) to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation; (iv) to impersonate or attempt to impersonate Temma Freight, a Temma Freight employee, another user, or any other person or entity; or (v) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of our website, or which, as determined by us, may harm Temma Freight or users of our website, or expose them to liability.
c. We reserve the right to terminate or restrict your access to our website, without notice or liability, if we determine, in our sole discretion, that you have violated this Agreement or any applicable law or regulation.
Payment
a. Pre-Payment: You may pay for your shipment at the time of booking. Payment can be made by credit card. By placing a booking, you agree to pay the full amount of the shipment, including any applicable taxes, fees, and surcharges. The amount required will depend on the nature and value of the shipment.
b. Post-Payment: In certain circumstances, Temma Freight may offer post-payment options for your shipment. If post-payment is available for your shipment, Temma Freight will invoice you for the shipment after it has been processed. You agree to pay the invoice within the time frame specified by Temma Freight. Temma Freight reserves the right to deny post-payment at its sole discretion.
c. Disputed Charges: If you dispute any charge on your credit card related to your shipment, you must notify Temma Freight in writing within 30 days of the charge. Failure to notify Temma Freight within 30 days will result in your waiver of any right to dispute the charge.
Shipping
a. Shipment Dates: Temma Freight will provide an estimated shipment date at the time of booking, but this date is subject to change. Temma Freight will use commercially reasonable efforts to deliver your shipment on the estimated shipment date, but we do not guarantee delivery on any specific date.
b. Customs Clearance: Temma Freight will provide assistance with customs clearance for international shipments, but we do not guarantee that your shipment will clear customs or that any fees or duties will not be assessed by customs officials. You are responsible for any customs fees, duties, or taxes assessed on your shipment.
c. Delivery: Temma Freight will deliver your shipment to the address specified at the time of booking. If the delivery address is incorrect or incomplete, you will be responsible for any additional charges associated with the delivery.
Liability
You may choose to add insurance to your shipments with a third party provider or by consulting Temma Freight the possibilities to add it to your shipment.
a. Temma Freight’s liability for any loss or damage to your shipment will be limited to the lesser of: (i) the actual value of the shipment; or (ii) the limit of liability established by the carrier that transports the shipment.
b. Temma Freight will not be liable for any consequential, incidental, or indirect damages arising from the loss or damage to your shipment, including but not limited to lost profits or business interruption.
c. You agree to indemnify and hold Temma Freight and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, or expenses arising from your use of our website or services, including but not limited to claims related to the loss or damage to your shipment, any violation of these terms and conditions, or any infringement of the rights of any third party.
d. You acknowledge and agree that Temma Freight is not responsible for any delays or other issues caused by carriers, customs agencies, or other third parties involved in the transportation of your shipment.
e. You acknowledge and agree that Temma Freight is not responsible for any loss or damage to your shipment caused by your failure to comply with applicable laws or regulations, including but not limited to customs regulations.
f. You acknowledge and agree that Temma Freight is not responsible for any loss or damage to your shipment caused by events beyond our control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
Intellectual Property
The Site and all content and materials on the Site, including but not limited to text, graphics, logos, images, and software, are the property of Temma Freight or its content suppliers and are protected by United States and international copyright laws. You may not copy, reproduce, distribute, or create derivative works from any content or materials on the Site without the
Cancellations and Refunds
a. Cancellations: You may cancel your shipment up to 48 hours after placing your order. After 48 hours, your shipment cannot be cancelled. To cancel your shipment, please contact Temma Freight customer service at info@temmafreight.com.
b. Refunds: There are no refunds for any cargo that is ready to ship or has already shipped. If you cancel your shipment within 48 hours of placing your order, Temma Freight will refund the full amount of any pre-payment made for the shipment. If you cancel your shipment after 48 hours, no refund will be provided.
Governing Law and Dispute Resolution
a. This Agreement and your use of our website and services will be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law.
b. Any dispute arising from or related to this Agreement, our website, or our services will be resolved exclusively through binding arbitration in Miami-Dade County, Florida. The arbitration will be conducted in accordance with the rules of the American Arbitration Association.
c. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of that party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
Modifications
Temma Freight Logistics Inc reserves the right to modify these terms and conditions at any time without notice. Your continued use of our services after any such modification constitutes your acceptance of the modified terms and conditions.
Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
